Applicability of 18 U.S.C. §2257

United States law at 18 U.S.C. §2257 and related regulations generally requires certain producers of visual depictions of actual sexually explicit conduct involving real persons to create and maintain age and identity records, and to post a statement identifying the custodian of those records.

Because Woolnight’s own published material consists of written fiction (and does not consist of Woolnight-produced visual depictions of real persons engaged in sexually explicit conduct), Woolnight does not maintain §2257 performer records for its text stories, and no custodian-of-records designation is required for that written content.
